Warranty

Action-Tek provides full post sale hardware warranty on any item purchased from our store. All parts purchased from Action-Tek are sold with the full manufacturer’s warranty, from one-year up to lifetime warranties.

Standard Warranty
All computer systems purchased from Action-Tek come with a comprehensive three years Standard Warranty, unless otherwise specified.
Under our “Standard Warranty” all major components of the computer including the CPU, Motherboard, RAM and Hard Drive are all covered for the full manufacturer’s warranty period, which is usually three years.
Service is inclusive of parts and labour, but does not include software issues and re-installation or configuration of the customer’s software.
The warranty is a return to base warranty and includes the repair or replacement of any faulty parts within the warranty period, at no charge to the customer.


Conditions of Warranty
To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded. Where legislation implies any condition or warranty, and that legislation prohibits us from excluding or modifying the application of, or our liability under, any such condition or warranty, that condition or warranty will be deemed included but our liability will be limited for a breach of that condition or warranty to the following:

(a) Our liability for Goods supplied on acceptance of an offer to purchase is limited to making good any defects by repairing the defects or at our option by replacement, within a period not exceeding twelve (12) calendar months after the Goods have been dispatched so long as:
  • defects have arisen solely from faulty materials or workmanship in original configuration
  • the Goods have not received maltreatment, inattention or interference;
  • defects have not resulted from any accessories or alterations made after dispatch of the Goods by us;
  • any manufacturers or distributors warranty stickers have not been removed or damaged;
  • the seals of any kind on the Goods remain unbroken; and
  • the defective parts are promptly returned at your cost to us.
(b) We may, at our sole discretion, give you a credit or refund for Faulty Goods in lieu of repair or replacement

(c) We are not liable for and you release us from any claims in respect of faulty or defective design of any Goods supplied unless the design has been wholly prepared by us and the responsibility for any claim has been specifically accepted by us in writing.

(d) Except as provided in these conditions, all express and implied warranties, guarantees and conditions under statute or general law as to the merchantability, description, quality, suitability or fitness of the Goods for any purpose or as to design, assembly, installation, materials or workmanship or otherwise are expressly excluded. We are not liable for physical or financial injury, loss or damage or for consequential loss or damage of any kind arising out of the supply, layout, assembly, installation or operation of the Goods or arising out of the our negligence or in any way whatsoever.

(e) Our liability for a breach of a condition or warranty implied by Div 2 of Part V of the Trade Practices Act 1974 (other than s 69) is, subject to these terms and conditions, limited to any one or more of the following:
  • the replacement of the Goods or the supply of equivalent Goods;
  • the repair of the Goods;
  • the payment of the cost of replacing the Goods or of acquiring equivalent Goods;
  • the payment of the cost of having the Goods repaired; or
  • software does not carry any warranty from the manufacturer.
(f) Our liability under s 74H of the Trade Practices Act 1974 is expressly limited, subject to these terms and conditions, to a liability to pay to the Customer an amount equal to:
  • the cost of replacing the Goods;
  • the cost of obtaining equivalent Goods; or
  • the cost of having the Goods repaired
  • whichever is the lowest amount.


Returning a Product
If you change your mind about a purchase or make an incorrect choice, we will provide you with a store credit within 14 days of delivery for unopened products (excludes CD's, DVD's, computer games and console games) This credit does not include delivery costs.

If the Product is damaged or Dead on Arrival or Dead Soon After Arrival we have indicated below what you should do and how Action-Tek will respond to the problem.

Action-Tek will not provide a refund or replace a product that has been misused, mishandled or incorrectly installed or serviced. It is the responsibility of the customer to ensure that all instructions and advice or warnings given by the manufacturer or supplier are followed.


Dead On Arrival Goods - "DOA"
A Product is considered DOA if it shows symptoms of a failure, or is discovered to be broken or defective when first taken from its packaging.

Our Customer Service Representative will provisionally determine whether the Product is DOA. Where a Product is provisionally determined as DOA we will arrange to provide a full refund or a replacement product, depending on your choice.

Where our representative has provisionally determined that a Product is DOA, return shipping will be arranged at the expense of Action-Tek.

If the Product is deemed by Customer Service NOT to be DOA, and is not covered by a warranty, we may refuse to replace the Product or give you a refund for the Product.

When a Product is replaced, your replacement Product becomes your property and the returned DOA Product becomes our property. Replacement Products are provided with the same warranty as the returned Product.


Dead Soon After Arrival Goods - "DSAA"
If you find a defect in a Product within a reasonable time after delivery and before you have used it a lot (14 days as a rule of thumb) you should notify Action-Tek and your claim will be treated in the same way as a DOA product (see "Dead On Arrival Products").

Warranty Claim
To return a product you must obtain a Return Authorization ("RA") number from Action-Tek before any goods are returned
  • Goods under warranty cover will be replaced or repaired by authorised product distributors or manufacturers.
  • All costs incurred in returning the product to us for repair, replacement or credits are your responsibility.
  • The RA number must be clearly written on a removable sticky label on the outside of the shipping carton.
  • Warranty on all equipment will be the manufacturers warranty and at the manufacturers discretion.
  • You must make sure that the returned product is suitably packaged in order to prevent damage during return shipping. We will not accept responsibility for goods, which are damaged or lost whilst in transit back to us. It is your responsibility to insure them.
  • We will not accept goods sent to us as receiver pays or without a clearly marked RA number.
  • RA numbers are only valid for 7 days, so we must receive the returned product into within this period, or you will require a new RA number
  • All warrantees are voided if returned product is found in any way to be mishandled, misinstalled, modified, tampered, abused, physically damaged, without serial number or used under wrong voltage etc.
  • Goods returned, with No Fault Found will be charged a minimum service fee of $50.00
  • All the products we sell are new and carry at least 12 months manufacturer warranty in Australia. If a product has additional manufacturer's warranty we will still take care of it for you but will ask you to pay for the delivery costs involved if it has been over a year since you purchased it.


Our Liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

Privacy Policy - Use And Protection

By placing your Order, you agree that we may store, process and use data collected from your Order Form for the purposes of processing your Order. If you so indicate on the appropriate section of your Order Form, by placing your Order you also agree that we may use such data, other than credit card details, in order to provide you with information from time to time on other Action-Tek Products that may be of interest to you. If you do not agree to our using such data in order to provide you with information on other Action-Tek Products, you should indicate your non-agreement on the appropriate section of your Order Form. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request

Credit Card Fraud

Whilst we employ the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers and don't store your credit card details on our system, Action-Tek will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
